These Terms and Conditions govern the use of public EV charging stations operated by Enev Networks Ltd (trading as "Enev"), registered in England and Wales under Company Number 147876442, with its registered office at 124 City Road, London, EC1V 2NX, United Kingdom. By using any Enev charging station — whether by tapping a contactless card, mobile wallet, or authorised RFID tag — you agree to these Terms in full.

1 Electric Vehicle Charging Services

These Terms govern the use of EV charging stations ("Chargepoints") operated by Enev Networks Ltd across the United Kingdom. Enev acts as the disclosed commercial agent and payment facilitation platform on behalf of commercial site hosts ("Landowners"), who are the principals supplying electricity to drivers.

Enev's services are fully compliant with the Public Charge Point Regulations 2023 (SI 2023/1168), the Consumer Rights Act 2015, and all applicable UK statutory requirements for public EV charge point operators.

2 Pricing & Transparency (SI 2023/1168, Regulation 9)

All prices are prominently displayed on the Chargepoint display screen prior to initiating a charging session, stated in pence per kilowatt-hour (p/kWh) inclusive of 20% VAT. There are no hidden fees, subscriptions, or connection surcharges unless clearly displayed on the terminal screen before you tap.

Statutory Requirement: In compliance with Regulation 9 of the Public Charge Point Regulations 2023, prices must always be displayed in p/kWh. If you believe a Chargepoint is not displaying the price clearly, please contact us immediately via support@enev.energy.

Enev reserves the right to update tariffs at any time, subject to the updated tariff being displayed on the Chargepoint terminal screen before the session commences. You are never bound by a tariff you have not been shown prior to initiating a session.

3 Pre-Authorisation & Payment Settlement

When you present your contactless card, Apple Pay, Google Pay, or other digital wallet at an Enev-connected payment terminal (such as Nayax or Payter), your issuing bank will place a pre-authorisation hold (typically £35.00) on your account to verify sufficient funds are available.

Pre-Authorisation Note: The pre-authorisation is not a charge. Only the actual electricity consumed during your session will be captured. The unused pre-authorisation hold will be released by your bank — typically within 1–5 working days, depending on your card issuer's processing schedule. Enev has no control over your bank's release timeline.

Final payment is settled against the exact kWh dispensed, multiplied by the p/kWh tariff displayed at session start. Session receipts itemising the energy consumed, total charge, VAT breakdown, and session timestamp are issued electronically to the email address you provide, where applicable.

4 Driver Responsibilities

By using an Enev Chargepoint, you agree to:

  • Ensure your vehicle and charging cable are undamaged, Type 2 or CCS/CHAdeMO compatible, and correctly fitted before initiating a session.
  • Move your vehicle promptly once charging is complete to keep EV bays accessible for other drivers.
  • Report any physical or electrical fault, damage, or safety hazard to our helpline immediately at 0800 861 1088 or support@enev.energy.
  • Not tamper with, vandalise, or attempt to bypass any Chargepoint hardware, payment terminal, or communications equipment.
  • Comply with all site-specific parking rules, EV bay time limits, and signage posted by the Landowner at the Site.
  • Use the Chargepoint only for its intended purpose of charging a compatible electric vehicle.

Enev accepts no liability for parking charges, clamping, fines, or towing arising from overstay at EV bays. Parking enforcement is solely the responsibility of the Landowner / site operator.

5 Contactless Payment Mandate (SI 2023/1168, Regulation 5)

In compliance with Regulation 5 of the Public Charge Point Regulations 2023, all Enev-connected rapid chargers (≥50 kW) and public chargers (≥8 kW) are fitted with a certified contactless payment reader, allowing any driver to pay by:

  • Contactless debit or credit card (Visa, Mastercard, Amex)
  • Apple Pay or Google Pay (and equivalent digital wallets)
  • Authorised RFID card or fob (where applicable at the site)

You are never required to download an app, create an account, or subscribe to use any Enev public charging station. Tap-and-charge is always available.

6 Session Metering & Receipts

All Enev Chargepoints record and transmit session telemetry via OCPP (Open Charge Point Protocol) to our cloud management system, including:

  • Session start and stop timestamps
  • Total kWh dispensed (energy meter values)
  • Charging rate in p/kWh
  • Total cost and VAT breakdown
  • Chargepoint identifier and site location

HMRC-compliant digital VAT receipts are generated for every completed session. Where an email address is provided at the payment terminal or via the Enev portal, receipts are despatched automatically. Receipts can also be retrieved at any time via the Enev Receipt Finder on our website using your payment card details.

7 Refunds & Chargebacks

If a charging session fails to deliver energy due to a Chargepoint fault after pre-authorisation has been placed, Enev will investigate the session telemetry and, where the fault is confirmed, will initiate a full refund to your original payment method.

To request a refund, contact support@enev.energy within 30 calendar days of the session, providing:

  • The date, time, and location of the session
  • The last 4 digits of the card used
  • A brief description of the fault experienced

Refunds are processed to the original payment method and typically appear within 5–10 working days, subject to your card issuer's timeline.

Chargeback Rights: Nothing in these Terms affects your statutory right to raise a chargeback with your card issuer under the Payment Services Regulations 2017 or your card scheme's chargeback procedures. However, raising an unjustified chargeback for a session where electricity was successfully delivered may result in your access to Enev Chargepoints being suspended.

8 VAT & Taxation

The supply of public EV charging is standard-rated for UK VAT at 20%. All prices displayed at Chargepoints and on receipts are inclusive of VAT. Enev Networks Ltd holds VAT Registration Number GB 921 4481 02.

Full VAT receipts are automatically generated for every session and can be used for business expense claims. The VAT receipt will identify the Landowner (the taxable principal making the supply of electricity) and Enev as the disclosed payment agent.

Where a Landowner operates under an HMRC-compliant Self-Billing Agreement (VAT Notice 700/62) with Enev, Enev generates invoices on behalf of the Landowner in accordance with HMRC's self-billing regulations.

9 Accessibility & Driver Support

Enev is committed to accessible EV charging. All public-facing Chargepoints managed by Enev display tariff information in a clear, legible format prior to the session commencement, in compliance with consumer protection standards.

In accordance with Regulation 13 of the Public Charge Point Regulations 2023, a freephone or standard-rate telephone helpline is maintained for EV driver issues relating to payment, authentication, and charging failures.

10 99% Reliability Standard (SI 2023/1168, Regulation 7)

Rapid chargers (≥50 kW) managed under the Enev platform are subject to the statutory 99% annual reliability benchmark set out in Regulation 7 of the Public Charge Point Regulations 2023 and monitored by the Office for Product Safety and Standards (OPSS).

Enev monitors Chargepoint availability in real-time via its CPMS and transmits open data feeds to national repositories as required under Regulations 10, 11, and 12. Live Chargepoint status is publicly accessible via the Enev network map.

Physical hardware downtime caused by electrical faults, power outages, vandalism, cable damage, or site infrastructure issues is the responsibility of the Landowner. Enev's liability is strictly limited to the uptime of its software platform and payment processing services.

11 Limitation of Liability

Nothing in these Terms excludes or limits Enev's liability for death or personal injury caused by its negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be limited under English law.

Subject to the above, Enev shall not be liable for:

  • Any indirect, incidental, or consequential loss or damage arising from your use of a Chargepoint;
  • Any damage to your electric vehicle, battery, or onboard charger caused by electrical faults, power surges, or defective Chargepoint hardware (which is the sole responsibility of the Landowner);
  • Any loss resulting from a cellular network or internet outage affecting the Chargepoint's connectivity;
  • Any parking charges, fines, or clamping arising from overstay at EV bays;
  • Delays in releasing pre-authorisation holds by your card-issuing bank.

Enev's total aggregate liability to you in respect of any single session or incident shall not exceed the amount actually paid by you for that session.

Your statutory rights as a consumer under the Consumer Rights Act 2015 are not affected by these Terms.

12 Data Protection & UK GDPR

Enev Networks Ltd is a registered Data Controller with the Information Commissioner's Office (ICO). We process personal data in connection with your EV charging sessions — including payment card tokens (masked PAN), session timestamps, energy consumed, and site location — for the following purposes:

  • Processing and completing your payment transaction
  • Generating and despatching your session receipt
  • Detecting fraud and ensuring PCI-DSS compliance
  • Complying with our statutory obligations as a CPO
  • Improving our platform and service quality

Enev is PCI-DSS compliant and does not store unencrypted card numbers. Payment card data is processed exclusively by certified Level 1 PCI-DSS payment gateways. For full details, including your rights to access, erasure, and portability, please review our Privacy Policy.

13 Governing Law & Jurisdiction

These Terms and Conditions and any dispute or claim arising out of or in connection with them (including non-contractual disputes) shall be governed by and construed in accordance with the laws of England and Wales.

Each party irrevocably agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any such dispute or claim.

These Terms do not affect any mandatory statutory protections available to you as a consumer under the laws of England, Wales, Scotland, or Northern Ireland.
